Is your work place as safe as you think?

Every time you go to work you should be safe in the knowledge that your employer is under a duty to ensure your safety and well being whilst you are there. Employers must ensure that the environment in which you work is safe and not hazardous to your health. They must also ensure that any work equipment, including display screen equipment such as computers, is regularly maintained and that you are properly trained to undertake every task you perform in your working day. Thankfully most of the time this is exactly what happens; however occasionally one or more of these duties are breached by your employer resulting in a personal injury.

For example you may find that an item of work equipment you have used day in day out malfunctions and causes you to suffer an injury. If the piece of equipment has not been properly maintained you would potentially have a claim against your employer for compensation for your injuries as they may be found to be in breach of the work equipment regulations.

Alternatively you could have been asked to perform a task that you have not been properly trained to do which leads to you suffer an injury. In this instance your employer would potentially be in breach of the health and safety at work regulations and you may be able to bring a claim against your employer for compensation.

You may also able to bring a claim against your employer for compensation for injuries suffered as a result of the negligence of one of your fellow employees as long as they were acting within their normal course of their employment. In this situation your employer may be held to be vicariously liable for the actions of your colleague and a claim may be brought against your employer.

It is a common misconception that accidents at work only happen in work environments where people use heavy machinery or to people who work in so called 'dangerous' or 'hazardous' jobs. Injuries can also occur in a variety of different work locations including office-based environments.

It is important to remember that your employer is under a legal duty to ensure your safety at work. If they do not do this and you are injured as a result it is highly likely that you will be able to bring a claim. If you feel that you have been injured at work due to the negligence of your employer we would be happy to discuss your claim with you in detail and confirm whether you have a potential claim.
